The interesting part about it is that under article 61, they get an extra year if they need it and then nothing else is specified. They are also hamstrung in a few relatively minor ways as to what can and can't be in the constitution, but as an nominally soverign state there's nothing that stops them immediately amending the constitution the minute they form it, and international agreements are as binding as the signing nations want them to be.

If they take an extra year then the TAL failed. So it would be pretty much a moot point by then.
