Combine this with Apple winning their patent dispute with HTC over being able to apply a regex to text to hotlink phone numbers, Samsung winning patents over Apple about talking on a GSM network and Apple still trying to win patents against Samsung about snapping a slide of your finger to vertical/horizontal, as well as BT suing Google for, well, everything then I think there's no question the patent system is completely stifling innovation and acting as a disincentive for new players to enter an industry.
Contrast this with the games industry where there's no patent disputes to speak of...
