Scary use of cruel and unusual. I can see it being used to justify demanding that prisons simply provide prisoners with their opioid of choice rather than cruelly forcing them to participate in rehabilitation programs.

On the other hand, this prisoner will no longer need to be butt hurt about his/her situation =P

My first reaction was the same as Kulaf. WTF.

After reading the decision it's not as outrageous as the article makes it sound.

Gender identity disorder is recognized as a "major mental illness", it was found that Kosilek would suffer great harm (by suicide or self mutilation) if his mental illness wasn't treated, and the Massachusetts Department of Corrections doctors prescribed sex change surgery as the only adequate medical care for his condition.

Certainly not a slam dunk decision, but not a WTF either.

The only part of this that saddens me is knowing how many productive, law abiding trans people are out there who can't get this surgery because their insurance (If they even have any) won't cover it.

I'm not totally opposed to the judgement given they *appear* to have done appropriate due diligence, but the precedent it could set is worrying if abused.
